Consumer court lawyer in Bangalore
Complaints about defective goods and poor service against builders, insurers, banks, online sellers and hospitals, before the District and State Consumer Commissions in Bengaluru.
When a company will not fix what it sold you
A flat handed over two years late. A health insurance claim rejected over a clause nobody explained. A bank charge that keeps coming back. A phone that died in a week and a seller who stopped answering. These are consumer disputes, and the Consumer Protection Act, 2019 gives you a forum built for them.
Consumer commissions (still called consumer courts by most people) are simpler and cheaper than a civil suit. You can file a complaint yourself. Many people do. A lawyer helps when the other side is a large company with its own legal team, when the papers are many, or when the facts need to be set out carefully to show a “deficiency in service”.
Which commission hears your complaint
Commissions work at three levels. The limit depends on the value of what you paid, not on how much compensation you ask for.
| Commission | Value of goods or services paid |
|---|---|
| District Consumer Commission | Up to Rs 50 lakh |
| State Consumer Commission, Karnataka | Above Rs 50 lakh, up to Rs 2 crore |
| National Commission, New Delhi | Above Rs 2 crore |
Bengaluru has more than one district commission. A complaint can usually be filed where you live or work, or where the company carries on business. A complaint generally has to be filed within two years of the problem arising, though delay can be condoned for good reason. Our guide to the consumer court in Bengaluru has the full process.
Filing online on e-Jagriti
Complaints are now filed online on e-Jagriti, the national portal for consumer commissions, which replaced e-Daakhil. We draft the complaint, upload documents, pay any fee that applies and track hearings. You can also check a consumer court case status on the same system.
Complaints we take up
Builders and developers. Delay in possession, a flat smaller than promised, poor construction, a refund that never came. Home buyers can often choose between the consumer commission and K-RERA. Which is better depends on what you want: a refund with interest, possession, or compensation. See RERA complaints in Karnataka.
Insurers. Health claims rejected for “pre-existing disease”, motor claims cut down, life claims refused. Read insurance claim rejected for the options, which also include the Insurance Ombudsman.
Banks and financial services. Wrong charges, failed transactions, loan closure disputes, refusal to return title documents after a loan is repaid.
E-commerce and online sellers. Fake or defective products, refunds not given, cancelled orders where money was taken.
Medical services. Negligence by a doctor or hospital can be raised as a deficiency in service. These complaints need medical records and often an independent medical opinion, so they take more preparation.
Defective goods. Vehicles, appliances, electronics and furniture, where the defect was not fixed under warranty.
How we approach a consumer case
We usually start with a legal notice to the company. A good number of disputes are settled at this stage, because a company would rather pay than defend a case. If the notice does not work, we file the complaint and present your case at the hearings, including written arguments and evidence by affidavit. If the order goes against you, an appeal lies to the next commission. See legal notices in Bengaluru.
Questions people ask
Can I file a consumer complaint without a lawyer?
Yes. The law allows you to file and argue your own case. Many people hire a lawyer for complaints against builders, insurers or hospitals, where the other side is represented.
How long does a consumer case take in Bengaluru?
The law sets short timelines, but in practice cases often take longer because of pending work and adjournments. Complaints that are well drafted and have all the documents attached move faster.
What is the time limit to file a consumer complaint?
Generally two years from the date the problem arose. A later complaint can be admitted if you explain the delay and the commission accepts the reason.
Can I go to consumer court for a builder’s delay?
Yes. A home buyer can complain of delay in possession as a deficiency in service. You may also have a remedy before K-RERA, and we can tell you which suits your case.
