Divorce lawyers for Banashankari, Bangalore
Help with the terms of a mutual divorce, alimony, a shared home or loan, custody and contested cases, for people in every stage of Banashankari.
Many couples who decide to separate have already agreed on the big question. What takes time is the detail: who keeps the flat, who pays the loan, how much alimony, and how the children will split their weeks. If you live in Banashankari and need a divorce lawyer to help settle those terms, or to fight a case your spouse will not agree to, JustJuris is in Janankshi Layout, RR Nagar 5th Stage, on the road that starts at Banashankari Temple Circle.
Writing a settlement that holds
A mutual consent divorce under Section 13B of the Hindu Marriage Act needs a year of living separately and a joint petition. The petition, or a separate settlement filed with it, should deal with every open point, because once the decree is passed it is hard to reopen. We usually go through:
- Alimony. A one-time amount or monthly payments, and when each instalment is paid. Many couples tie the last instalment to the second motion so neither side is left exposed.
- The home. If the flat is in joint names, whether one spouse buys out the other, whether it is sold, and who signs the release or sale deed.
- Loans. A joint home loan does not end with the divorce. The bank will still hold both of you liable until the loan is closed or transferred, so the settlement should say who pays and how the other is protected.
- Stridhan and gifts. What is returned, and when.
- Children. Custody, visiting days, school fees and who decides on schooling.
- Other cases. Withdrawal of any police complaint, maintenance petition or domestic violence case, in a set order.
The six-month gap between the two motions can be waived by the court in suitable cases. Mutual divorce in Bangalore explains when.
When there is no agreement
A contested divorce is filed on a ground such as cruelty or desertion and decided on evidence. It takes much longer, and interim orders on maintenance and custody are often made along the way. See contested divorce in Bengaluru. Some contested cases settle midway and are converted to a mutual divorce.
Maintenance and custody
Interim maintenance and litigation costs can be claimed during the case under Section 24 of the Hindu Marriage Act, and permanent alimony under Section 25. A wife and children can also claim under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 125 CrPC). See maintenance for wife and children. Custody is decided on the child’s welfare: read child custody in Bengaluru.

Questions people ask
What happens to our joint home loan after divorce?
The divorce decree does not change the loan contract. Both of you stay liable to the bank until the loan is closed, refinanced in one name, or the bank agrees to release one borrower.
Is alimony taxable?
The tax treatment depends on whether it is a lump sum or periodic payments. Speak to a chartered accountant before you fix the structure.
Can a mutual divorce be withdrawn after the first motion?
Yes. Either spouse can withdraw consent before the second motion is decided, and the court cannot grant a mutual divorce without consent at that stage.
