Divorce lawyers for Vijayanagar, Bangalore
Advice on divorce, custody of children and maintenance for people in Vijayanagar, Hampinagar, Attiguppe and Hosahalli, a few Purple Line stops from our office.
When a marriage is ending and there are children, most of the worry is about them. If you live in Vijayanagar and are looking for a divorce lawyer, JustJuris is in Janankshi Layout, RR Nagar 5th Stage, on the same metro line. We can talk through custody, the divorce itself and money in one private meeting.
Custody first
The family court decides custody on the child’s welfare, and the outcome of the divorce itself does not settle it. Things the court usually looks at:
- who has been looking after the child day to day
- schooling, and how far each parent lives from the school
- the child’s own wishes, if the child is old enough
- each parent’s working hours and the support at home, such as grandparents
Under the Hindu Minority and Guardianship Act, custody of a child under five is ordinarily with the mother. The parent who does not get custody is usually given visiting rights: weekends, part of the school holidays, video calls. You can ask for an interim arrangement soon after the case starts, so the child is not left waiting. Child custody in Bengaluru has the details, including the Guardians and Wards Act.
Mutual consent divorce
If you both agree, a joint petition under Section 13B of the Hindu Marriage Act is the gentler route for children, because the parenting plan is settled between you rather than fought over. You must have lived separately for at least a year. The six-month gap before the second motion can be waived in some cases. When one spouse is abroad, courts have in some cases allowed appearance by video. Read how long a mutual divorce takes.
Contested divorce
If your spouse does not agree, you file on a ground such as cruelty or desertion and prove it with evidence. These cases take longer, and custody, maintenance and sometimes police complaints run alongside them. Contested divorce in Bengaluru explains each step.
Maintenance
Child maintenance is the child’s right, separate from what a spouse may claim. The court can order maintenance for a wife and children under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 125 CrPC), and interim maintenance while the divorce is pending. School fees and medical costs are usually part of the calculation. See maintenance for wife and children.
The court
Cases from Vijayanagar are heard by the family courts in Bengaluru. Which one depends on where you married, where you last lived together and where each of you lives now. Your advocate can attend many routine dates for you, but expect to be in court in person on the key ones. More in our guide to the family court in Bengaluru.

Many people do not want their family or neighbours to know before they are ready. What you tell us stays with us. You can also ask the family court to hear the case in private.

Questions people ask
Can the father get custody of a young child?
It is possible, but for a child under five the law leans towards the mother. A father can still get custody if the court finds that is better for the child, and will usually get regular visits.
Can we change the custody arrangement later?
Yes. Custody orders can be changed if circumstances change, such as a move to another city or a change in the child’s needs. Either parent can apply to the court.
Does my spouse need to sign for me to meet a lawyer?
No. You can meet us alone. Your spouse only comes into it once a case or a joint petition is filed.
